On May 8, 2026, FDA announced guidance on enforcement priorities for certain unauthorized electronic nicotine delivery system products and nicotine pouch products. The update matters for Alaska because state officials have already warned retailers and distributors about unauthorized tobacco products.

What FDA Said

FDA said it is focusing on unlawful tobacco products that fail to comply with premarket authorization requirements, including counterfeit products and misdeclared products. The agency also said it will continue working with other federal agencies to seize and destroy illegal products at the border.

Pending Application Does Not Equal Authorized

FDA described circumstances where it does not intend to prioritize enforcement, but it also warned that falling within an enforcement policy does not indicate whether a product is likely to receive premarket authorization. That distinction is crucial for advertisers. “Not currently prioritized” is not the same as “authorized” or “approved.”

Youth-Appealing Elements Are A Red Flag

FDA said enforcement priority can change when a product has elements that appear underage-appealing, such as cartoon-like characters, products disguised as something else, or products resembling toys, phones, or gaming platforms. Alaska Retailers Should Document Their Shelf

An Alaska retailer should be able to explain what products are on the shelf, who made them, whether a PMTA or authorization claim is being made, and what source supports that claim. A publisher should ask similar questions before carrying paid product promotion.
